Work Injury

I was injured in a fall on 3/26/2012 at work. I fell from a ladder approximately 5-6 feet onto metal grating. The injuries were :head gash with large knot, tailbone, middle back pain and elbow ding and cut. I was taken to the company doctor about an hour to hour and a half after incident(safety manager was at lunch) the company doctor is in different town about 25 miles from our plant(we do have a local hospital about 5 miles from plant) arrived at clinic and had to give urine sample which is standard procedure. To make a very long story short : the doctor wiped off my head and elbow, said I wouldn't need stitches had my back and butt xrayed and said xrays looked normal, he never asked me to raise my shirt and never poked around on my back or asked specifically where the pain was(yes,I should have pointed ot out but I was still a little loopy) then he wrote a release to return to work on light duty and prescribed an antibiotic and painkiller (hydrocodone) and I was driven back to work. I called in sick the next two days because I couldn't hardly move on the 3rd day I was sp dizzy I couldn't stand, went to local emergency room, told them what happened ,doctor looked me over and had a ct scan done on my head. Scan came back negative, doctor said in his opinion I has sustained a concussion and the dizziness and headache would go away in a couple of days and said to follow up with company doc since this was workmans comp claim. Went to company doctor on next day and doctor said concussion diagnosis is by treating doctors opinion, I told him my back was still hurting and he said if it still hurt at next weeks appointment he would xray again, also mentioned that most employers really frown on back injury claims. I hobbled around for a week, had some extreme mood swings,my wife and kids walked around on eggshells or just avoided me altogether. At next visit I told dr I was still having back pain,he had me xrayed and again told me it looked normal and the only thing he saw was normal disc degeneratio for someone my age, I am 42 and never had a back problem before, he said he would send xray to radiologist to review. I also asked if the meds he prescribed would give me mood swings because I was very moody(angry to nearly just crying) he said no,those pills won't do that and that he was not a psychiatrist and how is he supposed to diagnose moody. He also told me how he had seen people fired over back injury claims and how hard it can be to prove. Also told me that they would probably make me do physical therapy for several weeks before they would go any further and did I realize that workmans comp required me to miss 7 days in a row before they would pay me for missed time at work, so I was gonna lose a lot of money with this incident. He wrote me a light duty excuse and I returned to work. His office contacted me several days later and said they were recommending an MRI but needed to wait for approval from workmans comp adjuster. On 04/24/2012 I had MRI performed, on 04/26/2012 nurse from company doctor called and said I was being referred to a back specialist because they found compression fracture on T-12 and two ruptured disc. On 05/03/12 I met back doctor and he had multiple xrays done, agreed that T-12 was damaged and told me my options, set next appointment for 2weeks to decide. At next appt he had Cray done and said other xrays were not as good, and now I have T-12 and L-1 damage. I have now asked workmans comp for a second opinion, that appt is coming up on 05/29/12. I feel like workmans comp/my employer are sending me to quacks, sorry but the back Dr. has had his medical license for 46 years which means he is in his 70's. My opinion is I came to work here healthy, my body should not be broken when I leave.

Hello.

Your post is extremely difficult to read with no paragraphs, but I scanned for the words "attorney" and "lawyer" and do not think they were found.

You need to contract a Workman's Compensation Attorney to help you with your case asap. They only charge if there is some type of settlement. They will review your case and make sure your employer is complying with the Workman's Compensation laws in your state.

I pray you can get help with your WC claim and the treatment and relief you need.

hi - sorry you are having such bad problems -

please know that worker's comp insurance looks out for the company's best interest - NOT THE EMPLOYEE!! so yes you will be given the run-around on your injuries -

As D ave has said you do need to get a WORKER'S COMP ATTORNEY - ASAP - this way you will know what your rights are etc., they will help you get 2nd opinions away from the worker's comp insurance -

please keep us posted what you find out - remember the attorney must deal with worker's comp claims only for your best interest -

take care - Joy
