I had a Total knee replacement in October 2012 and 2 months after during therapy started having ;ots of pain issues... Burning the back of my thigh above the knee....then shooting pains down the side of my hip into the knee sometimes all the way to the bottom of my foot. Before I had the knee replaced i had lots of falls because the knee would just give way. This is an L&I claim and I have no other insurance.. Now the Ortho Dr I am seeing requested a MRI but L&I denied it because it has nothing to do with the original injury. Prior to the knee replacement I had a meniscus repair in May of 2012. The ortho Dr stopped all pain medication the end of December 2012. I can not sleep on my right side at all...I dont get more than 2 hours a sleep at a time these days. My husband tells me when I do sleep I moan.... This is really starting to wear me down.. Over the counter medications do nothing.. I fell a week before the knee replacement in the bathroom and slammed my head and shoulder into a wall.. a few days later I woke and couldnt turn my head... The knee replacement was put on hold for 2 weeks and I went to a chiropracter ...L&I refused to cover it because it had nothing to do with the original injury. My neck got better and i had the surgery. THe stress of dealing with L&I is bad enough but now I am just trying to deal with constant pain... I cant go back and see the original physician because the ortho Dr is now my attending physician or so I have been told..I am trying to keep as mobile as possible..actually I dont have much choice because sitting or standing or walking are time oriented for me . 30 minutes of standing or sitting is all I can stand at one time.. Waling is limited because too much and the back of my leg is on fire. I am at a loss here because my funds are limited. Does anyone have any ideas?.

Have you spoken with an attorney? Sometimes that helps. I had to get one because the worker's comp doctor didn't want to treat my carpal tunnel, that was diagnosed three weeks before the cubital tunnel by an ortho my own doctor had sent me to. That was why I had to see the worker's comp doctor to start with, but then was diagnosed with a severely pinched ulnar nerve at my elbow a few weeks later by the doctor that they sent me to, and who also confirmed the carpal tunnel.

I'm very sorry you're going through this. I'm sure there's a lot of people on this site that could recommend something better, but I would consider speaking with an attorney...

I have read your narrative carefully and also read Lori's reply.

First, what is L&I?

The good news is that the ortho does want you to have more diagnostic testing, so he/ she is taking you quite seriously and wants to see what is going on.

If the ortho will not prescribe pain med for you, will he/ she refer you to a pain management specialist to treat your pain?

I would have to agree with Lori, that if your MD is recommending an MRI, or any testing, and the insurance is denying this, it would be a strong indication that you need legal counsel.

In personal injury cases, Worker's Comp cases, SSDI, your attorney is usually paid out of the ultimate settlement. This means that you don't have to pay anything to the atty until, and unless, you win.
